Consent to do Business Electronically and to Use Electronic Records and Signatures (“Consent”)

This Consent contains important information that you are entitled to receive before you consent to receive and execute electronic records. Please read this Consent carefully and download, save and/or print a copy for your records. This Consent covers all of your policies, accounts, products and services (collectively, “Products”) with Transamerica Life Insurance Company and its affiliates listed below (collectively, “we” or “the Companies”).

What is the purpose and scope of this Consent?

We are required by law to provide certain information to you in writing, which means that you are entitled to receive such information on paper. With your consent, however, we may provide you with such information electronically. By accepting this Consent, you are agreeing to receive such information electronically, and to otherwise conduct business with the Companies electronically.

“Conduct Business Electronically”, as such term is used in this Consent, means conducting transactions and otherwise communicating with the Companies electronically—that is, through a website, the Internet, a software application, a mobile device, or otherwise online. Conduct Business Electronically includes, for example, doing one or more of the following electronically:

  • Executing or accepting this Consent;
  • Executing and/or submitting an application for a Product and related documents;
  • Establishing an online account for your Product by registering at www.Transamerica.com and its affiliated sites;
  • Conducting transactions related to your Products with the Companies, which, by way of example, may include. but not be limited to the following:
    • Collateral assignments, amendments, redemptions, distributions, surrenders and withdrawals, subaccount transfers and investment options changes (including by percentages, where available), loans (where available), plan contributions, updating plan and participant account information, submitting claims, benefit elections, premium payments and future premium allocations, updating payroll information, changing beneficiaries, service requests and updating addresses and contact information (collectively, “Transactions”);
  • Accessing information about your Products, such as, transaction histories, benefits, confirmations, loan amount and values, issue date, plan information, contribution and payroll information, subaccount and investment statuses, employment status (if pertinent to your Product), Communications (as defined below) and personal information about the Product’s owner, insured, beneficiary, annuitant, or participant; and
  • Communicating with the Companies.

What does this Consent cover?

When you accept this Consent, you are agreeing that we may provide notices, disclosures, agreements, statements, records and other information and communications regarding your Products or your use of any Company online service (“Communications”) to you electronically (by email, by posting the information at the website at which you access your Product, or by other electronic means). Communications include information that the Companies are required by law or regulation to provide you in writing (the “Required Communications”), as well as other information regarding your Products or your access to online services related to your Products. Your consent will remain in effect until you notify us that you are withdrawing it.

Examples of Communications include:

  • This Consent and any amendments or updates;
  • The Terms of Use and Online Account Terms, the Online Privacy Statement and any other agreement regarding online access to your Products, and any amendments, updates or modifications thereto;
  • Statements, disclosures and notices regarding your Products; and
  • Account agreements, disclosures, statements, trade confirmations, shareholder notices and performance reports and tax reporting statements.

This Consent covers all of your Products with the Companies - if you have different types of Products with different Companies, such as a life insurance policy, a mutual fund, and an annuity contract, then this Consent applies to all Products issued by the Companies. Generally, your consent will not apply to any other person named as an owner on your Product. When you accept this Consent, or accept or sign any other Communication, electronically, you are applying your electronic signature to such documents and you will be bound to such Communication to the same extent as if you had signed your name on paper by hand.

If we determine that applicable law requires that a Required Communication be provided to you in paper form, notwithstanding this Consent, we will mail such Required Communication to you at the primary mailing address for you in our records. Similarly, even though you have provided the Companies with this Consent, we may require that certain Transactions be performed or Communications be provided on paper.

Can I get paper copies of Communications?

Yes. You may obtain paper copies of any Communications at no additional charge arising from your decision to Conduct Business Electronically with the Companies by contacting the Companies at the [address/telephone number] provided below.

In addition, for certain Products for which you have established an online account, you may be able to tell us how you would like to receive certain categories of Communications (e.g., electronic format only, paper format only, or both), by setting your preferences at the specific Product page through the Transamerica website from which you access your Products.

Should I maintain copies of this Consent and other documents I sign electronically?

It is recommended that you print and/or save the Consent and all Communications received electronically.

What if I change my mind?

You have the right to withdraw your Consent to Conduct Business Electronically at any time and at no charge, by mailing a withdrawal notice to the Companies at the mailing address set forth below. Please be aware that if you withdraw your Consent, you will no longer be able to perform certain functions on this site and you will need to conduct all Transactions using paper documents. Your withdrawal of Consent will become effective within a reasonable period of time after we receive your withdrawal notice.

What if my contact information changes?

You must keep the Companies informed of any changes to your email address(es) and all other contact information by promptly notifying the Companies through one of the contact methods set forth below. If you have more than one Product, you will have to update your contact information for each such Product.

Are there any hardware or software requirements to Conduct Business Electronically with the Companies?

Yes. To Conduct Business Electronically you will need access to certain minimum hardware and software requirements (“Technical Requirements”) set forth in more specificity on our Technical Requirements section. You will need access to:

  • A Supported Version (defined below) of an Internet browser;
  • An Internet connection;
  • A Supported Version of a program that accurately reads and displays PDF files (for example, Adobe Acrobat Reader);
  • An active email address; and
  • A computer and an operating system capable of supporting all of the above. You will also need a printer if you wish to print out and retain records on paper, and electronic storage if you wish to retain records in electronic form.

“Supported Version,” means a version of the software that is currently being supported by its publisher and by the Companies. You should check the Technical Requirements section periodically for updates on supported software and browsers. From time to time, we may offer services or features that require a certain type of browser of configuration. If we detect that your browser is not properly configured, we may provide you with a notice on how to properly update your browser. Also, the browsers we support may change over time. We reserve the right to discontinue supporting a certain browser or operating system if we believe that it suffers from a security flaw or other flaw that makes it unsuitable for use with the Products. If we change the Technical Requirements, and such change creates a material risk that you would not be able to perform Transactions, access the site, or otherwise receive Communications we will let you know of the revised Technical Requirements. Continuing to Conduct Business Electronically with us after receiving notice of the change in the Technical Requirements constitutes your assent to the revised Technical Requirements.

Communications in Languages Other Than English

Please note that we will only be able to Conduct Business Electronically with you in the English language. Future Communications can only be in English. If you are not fluent in English, you should consider obtaining the services of an interpreter or taking other steps to make sure that you understand any Transaction before entering into it. If you do not consent to Conduct Business Electronically with the Companies, you will need to complete all Transactions using paper documents and you will not be able to access or use certain online services.

I have CAREFULLY read this Consent and accept it voluntarily and with full knowledge and understanding of its terms and conditions. I have read the Consent using computer hardware and software that meets Technical Requirements described and section to below, and I have an active email account. I am also confirming that I am authorized to, and do, consent on behalf of all other Product owners, authorized signers, authorized representatives, delegates and participants associated with the Product(s). I will save a copy of this Consent for my records.

Mobile Device Compatibility
